Terms & Conditions

Please read carefully. By creating an account, accessing any feature, or participating in an interview or training programme on HireStrike Career, you agree to these Terms & Conditions. If you do not agree, do not use the platform.

1 Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User") and HireStrike Career, operated by its owners ("Company", "we", "us", "our"), governing your access to and use of the platform available at hirestrikecareer.com and related subdomains (the "Platform").

By clicking "I agree", completing registration, or using any part of the Platform, you confirm that:

  • You are at least 18 years of age (or the age of majority in your jurisdiction).
  • You have the legal capacity to enter into this agreement.
  • If acting on behalf of an organisation, you are authorised to bind that organisation.
  • You have read and accept our Privacy Policy and Cookie Notice.

2 Platform Overview & Eligibility

HireStrike Career is an AI-powered hiring and training platform that provides:

  • Candidate services - AI-conducted job interviews, automated assessments, and career training programmes.
  • Employer services - Job template creation, AI candidate matching, interview scheduling, and shortlisting tools.
  • College and institution services - Student training management, placement tracking, and analytics dashboards.

The Platform is intended for use within India. Users accessing the Platform from outside India do so at their own risk and are responsible for compliance with applicable local laws.

We reserve the right to restrict access to the Platform in any geographic region at our sole discretion.

3 User Accounts & Registration

3.1 Account Creation

Certain features require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep it updated. You must not impersonate any person or entity or misrepresent your affiliation.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at support@hirestrikecareer.com if you suspect unauthorised access to your account. We are not liable for any loss arising from your failure to safeguard your credentials.

3.3 Single Account

Each individual may maintain only one candidate account. Companies and colleges may maintain one account per registered entity. Creating duplicate accounts to circumvent restrictions or bans is prohibited.

3.4 Verification

We may verify the identity of users, employers, or institutions at any time. Providing false verification information is grounds for immediate termination of your account.

4 Candidate Terms

4.1 Interview Integrity

Candidates must complete interviews honestly and without assistance from third parties, AI tools, reference materials, or any other aids unless explicitly permitted by the employer. Use of any means to circumvent the Platform's proctoring systems is strictly prohibited and may result in permanent disqualification and notification to the employer.

4.2 Consent to AI Processing

By starting an interview, you consent to real-time AI evaluation of your spoken responses using Google Gemini. Your responses are processed to generate a readiness score and feedback. You may review our Privacy Policy for details on how this data is handled and retained.

4.3 Consent to Recording

Interviews may involve voice recording via browser microphone for transcription purposes. You will be clearly notified before any recording begins. You may decline, in which case the interview cannot proceed.

4.4 Assessment Results

AI-generated scores and feedback are indicative assessments only and do not constitute guarantees of employment, offers, or aptitude certifications. Employers make their own independent hiring decisions.

4.5 Training Programmes

Certificates issued upon training completion are recognition of course participation and assessment performance. They are not accredited qualifications and must not be represented as such.

5 Employer / Company Terms

5.1 Lawful Use

Employers must use the Platform in compliance with all applicable employment laws, including the Employment Exchanges (Compulsory Notification of Vacancies) Act 1959, Equal Remuneration Act 1976, and any applicable non-discrimination regulations. Job descriptions must not specify requirements that unlawfully discriminate on the basis of caste, religion, gender, disability, or other protected characteristics.

5.2 Data Responsibility

Employers act as independent data controllers for candidate information they access through the Platform. You are responsible for processing candidate data lawfully and in accordance with the Digital Personal Data Protection Act, 2023. HireStrike Career is not responsible for how employers use candidate data once downloaded or exported.

5.3 Accurate Job Postings

All job templates and postings must accurately describe the role, compensation, location, and requirements. Phantom job postings (roles not genuinely available) are prohibited and will result in account suspension.

5.4 Candidate Treatment

Employers must not contact candidates in an inappropriate, harassing, or unsolicited manner. All communications facilitated through the Platform must be limited to legitimate hiring purposes.

5.5 AI Matching Disclaimer

AI candidate matching and ranking scores are tools to assist human decision-making. Final hiring decisions rest entirely with the employer. HireStrike Career is not liable for hiring outcomes based on Platform-generated rankings.

6 College & Training Institution Terms

Colleges and training institutions ("Institutions") that onboard students to the Platform confirm that they have obtained necessary consents from students to share their data with HireStrike Career. Institutions are responsible for ensuring student eligibility (age, identity) before enrolment.

Institutions must not use Platform data (student performance, assessments, rankings) for purposes beyond internal academic and placement operations without obtaining additional student consent.

Access to the institution dashboard is granted based on an active subscription or agreement with HireStrike Career. Sharing dashboard credentials with external parties is prohibited.

7 AI-Powered Services

7.1 Nature of AI Output

HireStrike Career uses Google Gemini AI and Deepgram speech recognition to power interview evaluation and training features. AI outputs - including scores, transcriptions, feedback, and recommendations - are probabilistic in nature and may contain errors.

7.2 No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated output. AI scores should not be treated as definitive assessments of a candidate's ability, intelligence, or suitability for a role.

7.3 Human Review

Where AI-generated decisions have significant consequences (e.g., automatic rejection), we encourage employers and institutions to implement human review. The Platform provides tools for human override of AI rankings.

7.4 Third-Party AI Providers

Our AI services rely on third-party providers (Google, Deepgram). Use of these services is subject to their respective terms. We process data with these providers as described in our Privacy Policy.

8 Intellectual Property

8.1 Platform IP

All content on the Platform - including software, algorithms, design, text, graphics, logos, question banks, training materials, and AI models - is owned by or licensed to HireStrike Career and protected under applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written consent.

8.2 Your Content

You retain ownership of content you submit (e.g., interview responses, uploaded materials). By submitting content, you grant HireStrike Career a non-exclusive, worldwide, royalty-free licence to use, store, process, and display your content solely to operate and improve the Platform. This licence ends when you delete your account, subject to our retention schedule.

8.3 Feedback

Any feedback, suggestions, or ideas you provide about the Platform may be used by us without restriction or compensation to you.

9 Prohibited Conduct

You must not:

  • Attempt to reverse-engineer, decompile, or extract the source code of the Platform.
  • Use automated scripts, bots, scrapers, or crawlers on the Platform without written permission.
  • Upload malware, viruses, or any code designed to interfere with the Platform's operation.
  • Attempt to gain unauthorised access to any user account, system, or database.
  • Use the Platform to harvest personal data of other users.
  • Impersonate another person during an interview or create fictitious candidate profiles.
  • Circumvent any access control, rate limit, or security feature.
  • Use the Platform for any unlawful purpose or in violation of these Terms.
  • Submit false, misleading, or fraudulent information.
  • Conduct load or penetration testing on the Platform without prior written authorisation.

Violation of these prohibitions may result in immediate account suspension, permanent bans, and legal action where appropriate.

10 Payment & Subscriptions

Certain features of the Platform are available on a paid subscription basis. Subscription fees, billing cycles, and included features are described on our pricing page. By subscribing, you authorise us to charge the applicable fees to your designated payment method.

  • Renewal: Subscriptions auto-renew unless cancelled at least 48 hours before the renewal date.
  • Refunds: All fees are non-refundable except as required by applicable law (including the Consumer Protection Act, 2019) or as explicitly stated in a written agreement with HireStrike Career. Statutory refund rights are not excluded.
  • Price changes: We will provide at least 30 days' notice before changing subscription pricing. Continued use after notice constitutes acceptance.
  • Taxes: All applicable GST and other taxes are payable by the subscriber.

11 Disclaimers & Limitation of Liability

11.1 "As Is" Service

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.2 Availability

We do not guarantee uninterrupted, error-free access to the Platform. Scheduled and unscheduled maintenance may cause temporary unavailability. We are not liable for any loss arising from Platform downtime.

11.3 Limitation of Liability

To the maximum extent permitted by applicable law, HireStrike Career shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including lost profits, lost data, or hiring decisions based on Platform outputs.

Our total aggregate liability to any user for any claims arising under these Terms shall not exceed the fees paid by that user to HireStrike Career in the 3 months preceding the claim.

11.4 Employment Decisions

HireStrike Career is a technology platform, not an employment agency. We are not responsible for any employment decisions, offers, rejections, or outcomes that result from use of the Platform.

11.5 Force Majeure

HireStrike Career shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, civil unrest, government action, power or internet outages, failures of third-party infrastructure providers (including Google Cloud, Google AI services, Deepgram, or other cloud vendors), cyberattacks, or changes in applicable law. In such events, our obligations are suspended for the duration of the force majeure event. We will notify users as soon as practicable and resume performance once the event has passed.

11.6 Consumer Rights

Nothing in these Terms is intended to exclude or limit rights that cannot lawfully be excluded under the Consumer Protection Act, 2019 or any other mandatory applicable law. Where such rights apply, they take precedence over these Terms to the extent of any inconsistency.

12 Indemnification

You agree to indemnify, defend, and hold harmless HireStrike Career, its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms;
  • Your use of the Platform in a manner not authorised herein;
  • Any content you submit to the Platform;
  • Your violation of any third-party rights.

13 Termination & Suspension

We reserve the right to suspend or permanently terminate your account without prior notice if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Platform or its users.

You may close your account at any time by contacting support@hirestrikecareer.com. On account closure, your personal data will be handled in accordance with our Privacy Policy retention schedule. Certain data may be retained for legal compliance purposes.

Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnity, governing law) shall survive.

14 Governing Law & Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

14.2 Informal Resolution

Before initiating any formal proceedings, you agree to attempt informal resolution by contacting us at support@hirestrikecareer.com. We will make a good-faith effort to respond within 7 business days and resolve the matter within 30 days.

14.3 Arbitration

If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be finally settled by binding arbitration under the Rules of the Indian Council of Arbitration (ICA), as current at the date of commencement of arbitration, by a sole arbitrator appointed in accordance with those Rules. The seat and venue of arbitration shall be Bengaluru, Karnataka, India. The language of arbitration shall be English. The arbitral award shall be final and binding on both parties.

Nothing in this clause prevents either party from seeking urgent injunctive or interim relief from a court of competent jurisdiction to protect its intellectual property or confidential information.

15 Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email to your registered address and by a prominent notice on the Platform at least 15 days before the change takes effect.

Continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform and close your account.
